A restaurant is a private facility. It is owned by private owners and no one HAS to go there unless they want to. If they don't like to be around smoke, they dont' have to go to that restaurant. End of story as far as private facitilies are concerned.

I HATE cigarette smoke, can't stand it, and hate being near it most of the time. I try and sit as far away from it as I can in restaurants, but if I have to deal with it, I have to deal with it.

In public places, it's a public health issue. I wouldn't mind at all if all smoking was banned in public places. You're exposing the public to a health risk unncessarily, and people sometimes NEED to go to public places, therefore, they shouldn't be exposed to a health risk (second hand smoke, leading to cancer) while there.

Hell, I'm an advocate for legalizing all drugs. Your body, your choice, and as far as i'm concerned that's the end of it. But if you're in a public place, and you're putting me or someone else at risk and they can't do anything but stand there and take it, that's where those people's rights are being infringed upon, and the government's job is to stop that.

In a private facility, it is the right of the owner to allow whatever he wants to allow, as long as it falls within the rights that are reasonable, and it is absolutely reasonable, in my opinion, to allow customers to enjoy whatever intoxicants they want. It is NOT the government's right to regulate that sort of thing in private homes or private establishments.
